1. Acceptance of These Terms

Welcome to SpoilThePlot!

These Terms of Service ("Terms") govern your access to and use of the SpoilThePlot website, mobile applications, and related products and services (collectively, the "Services") operated by SpoilThePlot, LLC ("SpoilThePlot," "we," "our," or "us").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Services.

2. Eligibility

You must be at least 13 years of age to use the Services.

If you are under the age of majority in your jurisdiction, you represent that you have permission from a parent or legal guardian to use the Services.

3. Description of the Services

SpoilThePlot provides information and tools relating to books, including but not limited to:

  • Book summaries
  • Spoiler information
  • Content warnings
  • Reading recommendations
  • User accounts
  • Saved books and reading preferences
  • Author checklists and reading lists
  • Email and push notifications
  • Mobile applications
  • Related features and services

The Services are provided for personal, non-commercial use unless we agree otherwise in writing.

We may modify, improve, suspend, or discontinue any portion of the Services at any time without prior notice.

4. User Accounts

Certain features require a SpoilThePlot account.

You agree to:

  • Provide accurate information when creating an account.
  • Keep your account information current.
  • Maintain control of the email account associated with your SpoilThePlot account.
  • Notify us promptly if you believe your account has been accessed without authorization.
  • Be responsible for all activity occurring under your account.

You may delete your account through the SpoilThePlot mobile application (Settings → Delete account) or by contacting us. Details on what happens after deletion, and how to manage email or push notifications without deleting your account, are described in our Privacy Policy.

5. Passwordless Authentication

SpoilThePlot uses passwordless authentication through secure email "Magic Links."

Access to your SpoilThePlot account depends on your ability to receive email at the address associated with your account. You are responsible for maintaining access to that email account.

6. Electronic Communications

By creating an account or contacting us electronically, you consent to receive communications electronically, including notices relating to your account and these Terms.

7. Acceptable Use

You agree not to:

  • Violate any applicable law or regulation.
  • Use the Services for commercial purposes without our prior written permission.
  • Attempt to gain unauthorized access to the Services or related systems.
  • Reverse engineer, decompile, or attempt to extract source code except where permitted by law.
  • Interfere with the operation or security of the Services.
  • Upload malware, viruses, or malicious code.
  • Use automated tools to scrape or harvest content without our written permission.
  • Impersonate another person or organization.
  • Infringe the intellectual property rights of others.
  • Use the Services in any manner that disrupts other users' enjoyment of the Services.

8. User Content

Certain features may allow users to submit personal reading lists, author checklists, or other personal content ("User Content").

You retain ownership of your User Content.

By submitting User Content, you grant SpoilThePlot a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, modify (for formatting or moderation), and otherwise use your User Content for the operation, maintenance, improvement, promotion, and distribution of the Services.

You represent that:

  • You own the content or have permission to submit it.
  • The content does not violate applicable law.
  • The content does not infringe the rights of another person or entity.

We may review, edit, refuse to publish, or remove User Content at our sole discretion.

9. Feedback

If you voluntarily provide suggestions, ideas, feature requests, or other feedback regarding the Services, you grant SpoilThePlot the right to use that feedback without obligation or compensation.

10. Intellectual Property

Unless otherwise indicated, the Services—including the software, design, layout, graphics, logos, text, databases, original summaries, original editorial content, and other materials created by SpoilThePlot—are owned by SpoilThePlot, LLC or its licensors and are protected by applicable intellectual property laws.

Book titles, author names, publisher names, book cover images, trademarks, logos, and other third-party intellectual property remain the property of their respective owners and are used solely for identification, commentary, editorial, informational, or other lawful purposes.

Except as expressly permitted by these Terms or applicable law, you may not reproduce, distribute, modify, or create derivative works from SpoilThePlot content without prior written permission.

11. Book Content and Spoilers

SpoilThePlot provides summaries, spoiler information, ratings, editorial commentary, and content warnings regarding books.

Content may describe fictional events involving violence, death, abuse, trauma, or other mature themes.

Spoiler information is hidden by default and requires intentional user interaction before it is displayed.

Content warnings and summaries are intended to assist readers in making informed decisions and are provided for informational purposes only.

AI tools may assist in drafting certain portions of content on SpoilThePlot. Human editors review and finalize published material. We do not guarantee that all information will be complete or error-free.

Certain features may use automated systems to organize, summarize, or recommend content. Users remain responsible for evaluating information before relying upon it.

Opinions expressed by SpoilThePlot or its users may differ from those of authors, publishers, or readers.

Unless explicitly stated, SpoilThePlot is not affiliated with, endorsed by, or sponsored by any publisher, author, or rights holder.

12. Optional Tips and Payments

The SpoilThePlot mobile application may allow users to voluntarily provide tips to support the continued development and operation of the Services.

Tips are processed through Apple's In-App Purchase system or other authorized payment providers, as applicable.

Voluntary tips do not create any ownership interest, subscription, membership, or entitlement to additional features unless expressly stated.

Refunds, where available, are subject to the policies of the applicable payment provider and any requirements of applicable law.

13. Third-Party Services, Advertising, and Links

The Services may include links to third-party websites, retailers, publishers, payment processors, advertising partners, or other services.

Our website may display third-party advertisements, including advertisements served by Google AdSense or similar partners. The SpoilThePlot mobile application does not display third-party advertising.

Some retailer links on the Services may be affiliate links. SpoilThePlot, LLC participates in the Amazon Services LLC Associates Program, and as an Amazon Associate we may earn commissions from qualifying purchases.

SpoilThePlot is not responsible for the content, policies, or practices of third-party services.

Your use of third-party services is governed by their respective terms and privacy policies.

14. Open Source Software

Portions of the Services may incorporate software distributed under open-source licenses. Those components remain subject to their applicable license terms.

15. Service Availability

We strive to maintain reliable Services but do not guarantee uninterrupted availability.

We may:

  • Perform maintenance;
  • Update software;
  • Modify features;
  • Suspend access;
  • Discontinue portions of the Services

at any time.

We reserve all rights not expressly granted under these Terms.

16. Force Majeure

SpoilThePlot shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including natural disasters, acts of government, war, terrorism, labor disputes, internet or telecommunications failures, cyberattacks, power outages, or failures of third-party service providers.

17. Beta Features

We may designate certain features as Beta or Preview features. These are provided "as is" and may be modified or discontinued at any time.

18. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPOILTHEPLOT DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

We do not guarantee that:

  • the Services will always be available;
  • information will always be complete or error-free;
  • defects will be corrected immediately;
  • the Services will be free of harmful components.

19. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPOILTHEPLOT, LLC, ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SPOILTHEPLOT FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

Where applicable law does not permit certain limitations, those limitations apply only to the extent permitted by law.

20. Indemnification

You agree to indemnify, defend, and hold harmless SpoilThePlot, LLC and its owners, employees, contractors, and affiliates from claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • your use of the Services;
  • your User Content;
  • your violation of these Terms;
  • your violation of applicable law or the rights of another person.

21. Termination

You may stop using the Services at any time. You may delete your account through the SpoilThePlot mobile application or by contacting us, as described in our Privacy Policy.

We may suspend or terminate access to the Services if we reasonably believe you have violated these Terms, applicable law, or engaged in conduct that may harm the Services, other users, or SpoilThePlot.

Termination does not affect provisions intended to survive termination, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law.

22. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect personal information.

23. International Users

The Services are operated from the United States.

If you access the Services from another country, you are responsible for complying with local laws applicable to your use of the Services.

Information may be transferred to and processed in the United States as described in our Privacy Policy.

24. Export Controls

You agree not to use or export the Services in violation of United States export control or sanctions laws.

25. Apple App Store

If you download the SpoilThePlot application through the Apple App Store, you acknowledge that these Terms are between you and SpoilThePlot only, and not with Apple. Apple is not responsible for the application, its content, or its support. Your use of the application must also comply with Apple’s applicable App Store terms.

26. Governing Law and Venue

These Terms are governed by the laws of the State of Oregon, United States, without regard to conflict of law principles.

Except where prohibited by applicable law, any dispute arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Multnomah County, Oregon, and the parties consent to the jurisdiction of those courts.

27. Severability

If any provision of these Terms is determined to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

28. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms that apply to specific features, promotions, beta programs, or services, constitute the entire agreement between you and SpoilThePlot regarding your use of the Services and supersede prior agreements relating to the Services.

29. Changes to These Terms

We may revise these Terms from time to time.

If we make material changes, we will update the "Last Updated" date at the top of these Terms. Your continued use of the Services after the revised Terms become effective constitutes acceptance of the updated Terms.
